Terms of Use

By using this site and uploading recordings by any means including but not limited to photography, audio or video recording (hereinafter referred to as recording or recordings) visitors must agree to the following points:

  1. All recordings uploaded or linked are considered the property of POAC-NoVA and may not be sold or reused without the express written consent of POAC-NoVA.
  2. I grant permission to POAC-NoVA, their officers, directors, volunteers, advisors, agents, servants, or employees (hereinafter referred to as releasees), the irrevocable right to use the recordings for any purpose and without notifying me.
  3. I hereby waive any right to inspect or approve the recordings now or in the future, whether that use is known to me or unknown, and I waive any right to royalties or other compensation arising from or related to the use of the recordings.
  4. I hereby agree to release, defend, and hold harmless the above-named releasees, including any firm publishing and/or distributing the recordings in whole or in part, on any media, from and against any claims, damages or liability arising from or related to the use of the recordings, including but not limited to any misuse, distortion, blurring, alteration, optical illusion or use in composite form, either intentionally or otherwise, that may occur or be produced in taking, processing, reduction or production of the recording, its publication or distribution.
  5. It is my express intent that this Terms of Use shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a release, waiver, discharge and covenant not to sue the above-named releasees. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the Commonwealth of Virginia.
  6. In using this site, I acknowledge and represent that I have read the foregoing Terms of Use, understand it and agree to it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this release for full, adequate and complete consideration fully intending to be bound by same.
